Terms of Service — Again Automations

Acceptance of Terms

By accessing or using again.com.au (the “Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization (a “Tenant”), you represent that you are authorized to accept these Terms on its behalf.

The Service

We provide tools to import, process, and report on search performance data from sources such as Google Search Console. Features may evolve over time.

Accounts and Tenants

Registration: You must provide accurate information and keep it up to date.

Access: You are responsible for safeguarding credentials and any activities under your account.

Roles/Permissions: Tenant owners and admins can assign roles and permissions. You must use the Service only within the scope granted to you.

Compliance: You will comply with all applicable laws, and Google’s terms and policies when connecting Google accounts.

Subscriptions and Billing (if applicable)

Fees and Plans: If your use requires payment, fees, billing intervals, and renewal terms will be presented at checkout or in your order form.

Taxes: Prices may exclude taxes; you are responsible for applicable taxes.

Cancellations and Refunds: Unless stated otherwise, fees are non-refundable. Upon cancellation, access may continue until the end of the current billing period.

Acceptable Use

You agree not to:

Access or use the Service in violation of law or third-party rights.
Attempt to gain unauthorized access or disrupt the Service or underlying infrastructure.
Reverse engineer, decompile, or modify the Service except as permitted by law.
Use the Service to store or transmit malicious code.
Circumvent technical limitations or quotas.
Misrepresent ownership/authorization of Search Console properties.

Integrations with Google

OAuth and Scopes: You may connect your Google account to import Search Console data using read-only scopes.

Compliance: Your use of Google user data must comply with Google’s terms and the Google API Services User Data Policy (including Limited Use). You authorize us to access and process your Search Console data solely to provide the Service.

Revocation: You can disconnect your Google account at any time. Note that some features may become unavailable.

Intellectual Property

Our IP: The Service, underlying software, UI, and all related IP are owned by Again Automations or our licensors.

Customer Content/Data: You or your Tenant retain ownership of your data imported into the Service. You grant us a limited, non-exclusive, worldwide license to process such data solely to provide and support the Service.

Confidentiality

We will protect non-public information you share with us using safeguards no less protective than those we use for our own similar information. This does not apply to information that is public, independently developed, or received lawfully from another party without confidentiality obligations.

Privacy

Our use of personal data is described in our Privacy Policy. By using the Service, you consent to such processing.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, accurate, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, Again Automations and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to these Terms or the Service, even if advised of the possibility. Our total liability for any claim arising from or relating to these Terms or the Service will not exceed the amounts you paid to us for the Service in the 12 months preceding the claim (or $100 if you have not paid us).

Indemnification

You will defend, indemnify, and hold harmless Again Automations and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your data, or your violation of these Terms or applicable law.

Termination

We may suspend or terminate your access to the Service at any time for any reason, including violations of these Terms or legal/compliance requirements. You may stop using the Service at any time. Upon termination, your right to access the Service ceases, but certain provisions (e.g., IP, confidentiality, limitations of liability) will survive.

Changes to the Service or Terms

We may modify or discontinue features at any time. We may update these Terms from time to time. If changes are material, we will provide notice via the Service or email. Continued use after changes become effective constitutes acceptance.

Governing Law; Dispute Resolution

These Terms are governed by the laws of [Jurisdiction], without regard to conflict of laws. Any disputes will be resolved in the courts located in [Jurisdiction], unless otherwise required by law. You consent to personal jurisdiction and venue there.

Export and Sanctions

You represent that you are not located in a sanctioned country and are not on a denied party list. You will comply with applicable export control and sanctions laws.
